1. Agreement to Terms

By accessing or using Shot Scout ("the Service"), operated by Shot Scout Labs ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Shot Scout. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into this agreement.

3. Your Account

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activity that occurs under your account

  • Providing accurate and current registration information

  • Notifying us immediately at shotscout@shotscoutlabs.com of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose

  • Reverse engineer, decompile, or attempt to extract the source code

  • Use automated tools (scrapers, bots) to access the Service without written permission

  • Resell, sublicense, or commercially exploit the Service without our consent

  • Upload content that infringes third-party rights, contains malware, or violates law

  • Interfere with or disrupt the Service's infrastructure

  • Impersonate another person or misrepresent your affiliation

5. Intellectual Property

5.1 Our Content

The Service, including its design, code, branding, AI-generated content, and curated location data, is owned by Shot Scout Labs and protected by U.S. and international copyright, trademark, and other laws.

5.2 Your Content

You retain ownership of content you submit (saved shoots, custom notes, breakdowns). By submitting content, you grant us a non-exclusive, royalty-free license to store, display, and process it solely to operate the Service for you.

5.3 AI-Generated Content

Location breakdowns, gear recommendations, and similar AI-generated content are provided as-is for informational purposes. You may use them freely for personal photography projects.

6. Photography & Real-World Activity Disclaimer

Shot Scout helps you plan photography sessions but does not:

  • Guarantee the safety of any location

  • Verify that a location is publicly accessible or legally permits photography

  • Account for trespass laws, permit requirements, or private property rights

  • Predict weather or natural events with certainty

You are solely responsible for:

  • Obtaining any required permits or permissions

  • Respecting private property, posted rules, and local laws

  • Assessing your own safety at any location

  • Verifying weather conditions before traveling

We are not liable for any injury, loss, legal action, or damage resulting from your use of location or scheduling information from the Service.

7. Third-Party Services

The Service integrates with third parties (Google, Anthropic, Open-Meteo, Pexels, Ticketmaster, etc.). We are not responsible for the availability, accuracy, or content of third-party services. Your use of these is governed by their respective terms.

8. Subscription and Payment

Shot Scout is currently offered free of charge. If we introduce paid features in the future, separate billing terms will apply and you will be notified before any charges are incurred.

9. Service Availability

We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. We may:

  • Modify, suspend, or discontinue features at any time

  • Perform maintenance that temporarily reduces availability

  • Limit usage based on capacity or fair-use thresholds

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION.

WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SHOT SCOUT LABS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR PERSONAL INJURY, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Shot Scout Labs, its operators, and affiliates from any claims, damages, or expenses arising from your violation of these Terms, your use of the Service, or your infringement of any third-party rights.

13. Termination

You may delete your account at any time by contacting shotscout@shotscoutlabs.com.

We may terminate or suspend your account immediately, without notice, if you violate these Terms. Upon termination, your right to use the Service ceases and we may delete your data after a reasonable retention period.

14. Governing Law

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Maryland, and you consent to personal jurisdiction there.

15. Changes to These Terms

We may revise these Terms from time to time. Material changes will be announced in the app and via email. Continued use of the Service after changes take effect constitutes acceptance.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force.
